Our St. Jude Mobile Application – Data Use and Privacy Policy

This privacy policy governs your use of the Our St. Jude software application (the “Application”) on a mobile device that was created by St. Jude Children’s Research Hospital. The Application includes access to relevant content and education, patient and family events, campus directions and more.

PLEASE READ THIS PRIVACY POLICY CAREFULLY TO UNDERSTAND HOW WE HANDLE YOUR INFORMATION. IF YOU DO NOT AGREE TO THIS PRIVACY POLICY, DO NOT USE THE APPLICATION.

What information does the Application collect?

1.    Information you provide us

The Application obtains information you provide when you download and sign in to the Application with an active MyChart account, as well as when you use it. In order to use this application, you confirm that you are an approved authorized user. If you do not agree to be bound by this Agreement, click “DECLINE.” If you decline, you will not be able to use the Our St. Jude Mobile Application. We may also use the registration information you provide us to contact you from time to time to provide you with important information and required notices.

2.    Information collected automatically

When you use the Application, we may automatically receive certain information about the device you use to access the Application. This information may include, but is not limited to, mobile device identifier, IP address, operating system, version and internet service provider, whether and when you update the Application, and usage data, such as the date and time you used the Application, what portions of the Application you used, and what type of content you accessed or downloaded.

Does the Application collect precise real time location information of the device?

No. This Application does not collect information about the location of your mobile device

How does the Application use my information?

We or our service providers use the information we collect for a variety of purposes, including:

  • Provide you with the services that you requested via the Application;
  • Contact you from time to time to provide you with required notices, Application updates, and other important information related to your use of the Application;
  • Respond to your requests for information;
  • Help us better understand your interests and needs;
  • Provide, manage, and improve the Application and St. Jude’s services;
  • Secure the Application, services, and facilities;
  • Understand and resolve technical issues in the Application, such as crashes and bugs;
  • Comply with any procedures, laws, or regulations that apply to us;
  • Establish, exercise, and defend our legal rights.

Do third parties see and/or have access to information collected by the Application?

We may disclose your information: as required by law, such as to comply with a subpoena, or similar legal process; when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, to investigate fraud, or to respond to a government request; to our trusted services providers who work on our behalf (but only if they agree not to use your information for any purpose other than helping us and if they have agreed to adhere to the rules set out in this policy).

Can I stop the Application from collecting my information?

Yes. You can stop all collection of information by the Application easily by uninstalling the Application. You can use the standard uninstall processes that are available as part of your mobile device.

Will you keep and store my information?

We will keep your information for as long as necessary to complete the purpose for which you provided the information, to allow us to analyze and verify the information. If you’d like us to delete your information, please contact us at InfoOurStJude@stjude.org. We will respond within a reasonable time. Please note that some of your information is required in order for the Application to work properly, and that we may be required to retain certain information by law.

What if children use the Application?

We will not use the Application to market to any user of any age. We will give parents and guardians of children the right to decide if their child’s information will be disclosed to third parties, the right to review that information, and the right to stop further collection of that information. We will not ask a child, or any other user, to provide information we don’t need, and we will strive to maintain the confidentiality, security, and integrity of any information that children, or any other users of the Application, do provide. Patients ages 14-17 may user their own St. Jude MyChart account to access the Our St. Jude mobile application. If a parent or guardian becomes aware that his or her child who is younger than 14 has provided us with information without the parent’s or guardian’s consent, the parent or guardian should contact us at InfoOurStJude@stjude.org. We will delete such information from our files within a reasonable time unless we are required by law to retain it.

What will you do to protect the security of my information from hackers and other threats?

We are committed to protecting the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve the Application. Although we try to provide reasonable security for information we process and maintain, no method of transmission or storage is absolutely secure. We cannot guarantee the security of information transmitted to, through, or on the Application.

Will you change this policy?

We may update this policy from time to time as we think appropriate. We will notify you of any changes to this policy by posting the new policy here https://osj.stjude.org/privacy. You should consult this website regularly for any changes.

What does my consent mean?

You are consenting to our use of your information as set out in this policy. We process your information in several ways, including, but not limited to, collecting, storing, deleting, using, combining and disclosing it, all of which will take place in the United States, where data protection and privacy regulations may not offer the same level of protection as in other parts of the world. By using the Application and providing information to us, you consent to such transfer to, and processing in, the US, which may not offer a level of protection equivalent to that required in other countries, and to the processing of that information as described in this Privacy Policy.

AS A USER OF OUR ST. JUDE APPLICATION (THE “APPLICATION”), YOU UNDERSTAND THAT THIS APPLICATION IS NOT AVAILABLE TO THE GENERAL PUBLIC. St. Jude Children’s Research Hospital (“St. Jude”), gives you non-transferable, non-exclusive permission to (i) install the Application on your personal device and use the Application

You agree that the Application has not been approved or reviewed by the U.S. Food and Drug Administration or by any other U.S. or ex-U.S. agency. The Application is not a substitute for professional medical advice, diagnosis or treatment.

ST. JUDE WILL HAVE NO LIABILITY TO ANY PATIENT OR ANY OTHER PERSON WITH REGARD TO THE USE OF THE APPLICATION. ST. JUDE ASSUMES NO LEGAL LIABILITY OR RESPONSIBILITY FOR THE ACCURACY, COMPLETENESS, SUITABILITY, OR USEFULNESS OF THE APPLICATION OR RELATED INFORMATION, OR DEFECTIVE OR DAMAGED DEVICES ON WHICH THE APPLICATION IS INSTALLED OR OPERATED. ANY LIABILITY ARISING DIRECTLY OR INDIRECTLY FROM THE USE OF THIS APPLICATION IS HEREBY DISCLAIMED. THE APPLICATION, AND ALL RELATED INFORMATION, IS PROVIDED “AS IS” AND WITHOUT ANY WARRANTY EXPRESSED OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

You agree to treat the Application as proprietary and confidential information of St. Jude, whether or not the Application, or any portion thereof, are copyrighted. You agree to safeguard the Application to the same extent and in the same manner that you safeguard your own confidential information, but in no less than a reasonable manner.
